1. Introduction

Sanad welcomes you and affirms its commitment to protecting the privacy of its users, including content creators, clients and visitors. This policy explains how we collect, use and protect your personal data when you use our services, in accordance with the laws and regulations in force in the Kingdom of Saudi Arabia. This policy is subject to the Personal Data Protection Law issued by Royal Decree No. (M/19) and its Implementing Regulations, the Anti-Cyber Crime Law, and all other relevant regulations in the Kingdom of Saudi Arabia.

2. Data We Collect

We may collect and process the following data:

• Contact data: name, email address, phone number, address.
• Account data: username, password, account settings.
• Identity data: national ID / Iqama, or commercial registration (for companies).
• Financial data: payment methods, invoices, transaction details, and the bank account of individuals or companies.
• Technical data: IP address, device and browser type, usage logs.
• Content creator data: social media accounts, number of followers, engagement, published content.
• Usage data: clicks, pages visited, time spent browsing.
• Order data: order details, conversations on the platform, delivered content, and the record of approvals and revisions with their dates.
• License data: the “Mawthooq” license for content creators, and any other statutory licenses the nature of the service requires.

3. How We Use Data

• Managing your account and providing the services.
• Connecting content creators with clients and running marketing campaigns.
• Issuing invoices and processing payments.
• Improving our services and the user experience.
• Complying with legal and regulatory requirements.
• Preventing fraud and misuse.
• Deciding refund requests and disputes between users, and verifying that each party met the set deadlines.
• Verifying the user’s identity, eligibility and the validity of their statutory licenses.

4. Sharing Data

We may share your public data on the platform with:

• Clients: to facilitate collaboration with content creators.
• Official authorities in the Kingdom of Saudi Arabia where there is a legal obligation.
• Service providers such as payment companies or analytics services.

Sanad does not sell the data of content creators or clients to any third party.

5. Your Rights

• Request a copy of your personal data.
• Request that your data be corrected or updated.
• Request that your data be deleted (unless keeping it is required by law).
• Object to the processing of your data for direct marketing.
• Withdraw your consent at any time.

6. Data Security

We apply high technical and administrative standards to protect your data; however, absolute security cannot be guaranteed. The user is responsible for keeping their login details confidential and for everything done through their account, and must notify Sanad immediately if any unauthorized access is suspected.

7. Children’s Privacy

Our services are intended for people aged 18 or over, and we do not knowingly collect children’s data.

8. Cookies and Similar Technologies

We use cookies to improve the browsing experience and to analyze performance. You can control them through your browser settings.

9. Policy Updates

We may update this policy, and you will be notified of any material changes through the platform or by email.

10. Limitation of Liability

Sanad operates as a technical and commercial intermediary to facilitate managing marketing with content creators in accordance with the platform’s policies. Sanad bears no direct or indirect liability for resulting damages, or for any loss or harm arising from an act or omission by a third party. Nor is Sanad liable for changes to the policies of social media platforms that stop or encrypt the provision of services and so require the service on Sanad to be suspended, as these are unforeseeable force majeure circumstances; Sanad disclaims all material, moral and legal liability for them, and the contract between Sanad and the client remains in force according to Sanad’s capabilities. All of this applies to the extent permitted by the regulations in force in the Kingdom of Saudi Arabia.

11. Force Majeure

In the event of any force majeure or boycotts; disputes between employees and employers, including strikes or lockouts; social media platforms refusing to allow Sanad to make use of data; the platform being hacked; communication problems; attempts to develop or update the system and any failures arising from them; any other natural disaster; or any other events beyond Sanad’s control that were not caused by negligence on Sanad’s part, could not reasonably be foreseen, and prevent or hinder Sanad from performing its contractual obligations — Sanad shall not be liable for those obligations, and this shall not be considered a breach of its contractual obligations. All of this applies to the extent permitted by the regulations in force in the Kingdom of Saudi Arabia.

12. Platform Records

The user acknowledges that the records kept on Sanad — orders, conversations, content and timings — are the authoritative reference in any dispute, and that no communication or agreement made outside the platform will be relied upon. Sanad may review these records when there is a report or a dispute, and this shall not be considered a breach of privacy.

13. Protection of Platform Data

No data or content may be collected, copied, extracted or stored from Sanad, manually or with any automated tool or program, without Sanad’s prior written consent. This includes the data of content creators and clients, prices and offers. Any violation is an infringement of Sanad’s rights that exposes the violator to legal accountability under the Anti-Cyber Crime Law, and Sanad reserves the right to claim compensation.
